Tammi is an AI-powered SMS assistant for real estate professionals, operated by RandyClaw LLC, a Wyoming limited liability company. By creating an account, subscribing, or sending or receiving messages through Tammi, you agree to these Terms.

1. AI Disclosure (read first)

Tammi is an automated software service powered by artificial intelligence. Tammi is not a human being, not a licensed transaction coordinator, not an attorney, and not a real-estate broker; it identifies itself as an AI assistant in messages. Because Tammi relies on AI — including reading documents from photographs and extracting dates and figures — it can and sometimes will make mistakes: it may misread a contract, extract an incorrect date or amount, miscalculate, generate inaccurate text, or fail to send or receive a message. YOU, THE AGENT, ARE SOLELY RESPONSIBLE FOR INDEPENDENTLY VERIFYING EVERY DEADLINE, DATE, AMOUNT, DOCUMENT, AND MESSAGE AGAINST THE UNDERLYING CONTRACT AND YOUR OWN RECORDS BEFORE RELYING OR ACTING ON IT. Do not rely on Tammi as your sole source of truth for any transaction-critical date or obligation. Client-facing emails are drafted for your review and sent only after you approve them.

2. Who These Terms Bind

These Terms are a binding agreement between RandyClaw LLC ("we" / "us") and you, the real-estate agent, broker, or brokerage ("you" / "Agent") who creates an account. By creating an account, subscribing, or sending or receiving messages through Tammi, you accept these Terms. Tammi communicates with your clients and transaction parties, who are not subscribers; you are responsible for that relationship and for obtaining all consents in Section 5.

3. The Service

Tammi provides automated, AI-assisted transaction-coordination support by SMS/MMS and email — reading contracts you send, tracking deadlines, drafting communications for your approval, commission calculations, vendor storage, and electronic signatures via third-party providers where enabled. Features may change; some are tier-gated; we do not guarantee any feature is error-free.

4. Subscriptions & Fees

Tammi is provided on a recurring subscription basis (monthly unless stated) processed by PayPal; you authorize the recurring charge. Founding and promotional rates apply only per their stated conditions, including the "$50/mo founding rate locked for life" offer for qualifying founding members. Except where required by law, fees are non-refundable. You may cancel at any time; cancellation stops future billing at the end of the current period. This is an auto-renewing subscription until cancelled. Usage and fair-use caps may apply.

5. Your Consent Obligations (TCPA / Messaging)

For every phone number or email you provide or use with Tammi, you represent and warrant that you have obtained all legally required consents for that person to be contacted by you and by an automated system on your behalf (including autodialed or automated texts and emails); you have a legitimate consented relationship with them; you are NOT uploading purchased, scraped, or rented lists without proper consent; you will honor all STOP / opt-out and unsubscribe requests; and you will comply with the TCPA, Do-Not-Call rules, CAN-SPAM, fair-housing, real-estate advertising, and other applicable laws. YOU ARE SOLELY RESPONSIBLE FOR ENSURING CONTACTING ANY PERSON THROUGH TAMMI IS LAWFUL.

6. No Legal or Brokerage Advice

Tammi does not practice law, give legal advice, or interpret the meaning or adequacy of contract terms. Any structural flags Tammi surfaces (for example, a blank date or a missing signature) are informational only, not legal advice. Tammi is not a broker and gives no brokerage, financial, tax, or accounting advice. You are the licensed professional; all professional judgment and compliance remain yours.

7. Acceptable Use

No unlawful use, malicious content, reverse-engineering, unauthorized resale or white-labeling, misrepresenting Tammi as human where disclosure is required, or violating third-party rights. We may suspend or terminate accounts that violate these Terms or create legal or reputational risk.

8. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT TAMMI WILL BE ERROR-FREE OR UNINTERRUPTED OR THAT ITS OUTPUTS (INCLUDING EXTRACTED DATES, AMOUNTS, OR DOCUMENTS) WILL BE ACCURATE OR COMPLETE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST COMMISSIONS, MISSED DEADLINES, LOST DEALS, OR LOST DATA, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) FEES YOU PAID US IN THE 3 MONTHS BEFORE THE EVENT OR (B) $100.

9. Indemnification

You will defend, indemnify, and hold harmless RandyClaw LLC and its owner, members, and agents from any claims, damages, liabilities, penalties, and expenses (including reasonable attorneys' fees) arising from: (a) your use of Tammi; (b) your breach of these Terms; (c) your failure to obtain required consent or to comply with the TCPA, Do-Not-Call, CAN-SPAM, fair-housing, or other messaging or real-estate laws; (d) your reliance on any Tammi output without independent verification; and (e) your violation of any third-party right.

10. Data & Privacy

Your use of Tammi is governed by the Privacy Policy, which is incorporated by reference. You are responsible for having the right to share any client or third-party information you provide.

11. Term, Termination & Changes

These Terms apply while you use Tammi. You may cancel at any time. We may suspend or terminate for violations or for legal compliance. We may update these Terms; material changes will be posted with a new date, and continued use is acceptance.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, seated in Wyoming, rather than in court, except that either party may seek relief in small-claims court for qualifying claims. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION; disputes are resolved only on an individual basis. If the class-action waiver is held unenforceable, the arbitration clause is void as to that claim only and it proceeds in Wyoming courts. Venue for any non-arbitrable matter lies in the state or federal courts located in Wyoming. If any provision is unenforceable, the rest remains in effect. These Terms are the entire agreement regarding the Service.
